How is the Emissions Reduction and Reclamation (ER&R) Program related to the AIM Act?
The AIM Act (American Innovation and Manufacturing Act) is a federal level regulation enacted to reduce the global warming impact of hydrofluorocarbons (HFCs). The AIM Act authorizes the EPA to address HFCs through three main initiatives: the Phasedown of HFC Consumptions and Productions, the Emission Reduction and Reclamation (ER&R) Program, and the Technology Transition Program. As part of the AIM Act, the Emissions Reduction and Reclamation (ER&R) Program aims to minimize greenhouse gas emission and encourage reclamation of HFCs.
What is the ER&R Program and how does it affect the refrigerant industry?
The Emissions Reduction and Reclamation program is set to minimize release and maximize reclamation of HFCs. The program has two main focuses:
Reclaimed gas usage: Mandates the usage of reclaimed refrigerants (i.e., refrigerants that contain no more than 15% of virgin HFCs by weight) for certain use cases.
Used disposable cylinder returns: Requires either end-users to return used HFC disposable cylinders or 608 technicians to evacuate cylinders to a vacuum level of 15 in-HG prior to disposal.
Proposed timelines
Reclaimed gas usage: Starting on January 1, 2029, the following use cases are required to use reclaimed HFCs for servicing and repairs.
Supermarket systems
Refrigerated transport
Automatic commercial ice makers
Used disposable cylinder returns: Starting on January 1, 2028, end-users are required to process used disposable HFC cylinders by one of the two options:
Option 1: Send certain disposable cylinders to either an EPA Clean Air Act (CAA) section 608 certified reclaimer, a fire suppressant recycler, a final processor, such as a landfill operator or scrap metal recycler, or a refrigerant supplier (including, but not limited to distributors and wholesalers) for its remaining contents to be removed.
Option 2: An 608 certified technician evacuates a disposable cylinder to a vacuum level of 15 in-Hg, and provides a certification statement to the final processor.
